Thank you for your enthusiasm for our employment program and your willingness to participate in this initiative. To submit your story, photograph or other media to NDSS, please carefully review and accept our Terms and Conditions. This is a legal agreement between you and the National Down Syndrome Society, a nonprofit corporation.
NDSS Employment Program Terms and Conditions Agreement
I am submitting my story, photographs, quotes, information and/or other media (collectively, “Submission”) to the National Down Syndrome Society (NDSS) for use in its employment initiative or for any other NDSS program or event. I represent and warrant that I am at least eighteen (18) years old, and the Submission is (i) truthful; (ii) original and (iii) has not been copied from any other source. I represent and warrant that I have permission of every person whose name is mentioned or identity is revealed in the Submission to use that person’s name and identity in the Submission. I also have the permission of every person who appears in any photograph or other media relating to the Submission to use that person’s photograph or image. If the story is not about me, but is about a person with Down syndrome, I have the permission of that person to submit the Submission.
I understand that by submitting my Submission and all related documents to NDSS, I grant to NDSS and its affiliated organizations a perpetual license to use, distribute, edit or republish my Submission, in whole or in part, including without limitation my name, likeness, and voice, for advertising, promotional, and any other commercial or noncommercial purpose.
I agree that NDSS has no obligation to use the Submission, and that I will not receive any compensation for the Submission. If NDSS publishes the Submission, it may also publish my name and state of residence with the Submission. NDSS has the absolute right to edit and revise the story, to edit or alter any photograph or other media relating to the Submission, in any way it sees fit in order to make it suitable for publication on the NDSS website or in any other employment-related materials.
I hereby grant NDSS a perpetual, non-exclusive, royalty-free, no-cost worldwide license to the copyright and all other rights in the Submission. This means that NDSS may use the Submission, in whole or in part, as submitted or revised, in any way and in any existing or future format, and has the right to publish and re-publish it on the NDSS website and elsewhere, copy it, publicly display it, publicly perform it, broadcast it, or make derivative works from it, and grant others the right to do the same.
I agree that NDSS may use for publicity and/or promotional purposes in any and all forms of media (now and hereafter known), my name, image and likeness as contained in the Submission and any other materials I submit to NDSS in connection with the Submission.
In no event shall NDSS be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from or related to this Agreement, the Submission or any content contained therein. This Agreement will be governed by the laws of the State of New York, and if any provision of this Agreement is deemed by a court to be invalid or unenforceable, the remainder of this Agreement shall remain in effect.
By submitting your story you are confirming that you understand and accept all of the terms and conditions of this Agreement.
